By submitting your rental, you are agreeing to the following terms:

PAYMENTS: This is a month-to-month rental-purchase agreement that automatically renews with each monthly payment.  Customer may cancel the rental agreement at any time by returning the instrument to Voigt Music Center, Inc (hereafter “VMC”). The first month’s payment is not refundable. No refunds will be given for partial months past 5 calendar days of a payment.
AUTOPAY: Customer authorizes an autopay via the payment method on file for the initial and subsequent monthly rental payments on the autopay date, and on the same date of each month thereafter, until the instrument has been returned to the store and/or all debts related to this agreement have been satisfied. Customer is a duly authorized signer of the account and authorizes this agreement by their electronic signature.
TITLE & OWNERSHIP: Title, ownership, and right of possession of the instrument and included accessories (hereafter collectively referred to as “instrument”) will remain with VMC until the “Total Payments to Ownership”, plus any past due rent, late, or NSF fees have been paid in full. Only the “Monthly Rental” payments (not including tax) will apply towards the purchase of the instrument. Only after the “Total of Payments for Ownership”, plus any past due rent, late, or NSF fees have been paid in full, title of the instrument will be transferred to Customer. Customer agrees to not sell, dispose, or mortgage the instrument until ownership transfer to customer.
EARLY PAYOFF DISCOUNT: A 30% discount off of the remaining payoff balance is available at any time to take ownership of the instrument. Payment must be made in-full and include any other amounts due under this agreement.
INSTRUMENT SWITCHES: The instrument may be switched to a different instrument within 60 days of the date of this agreement, and any “Monthly Rental” payments made will carry over to the replacement instrument. Any instrument switch after 60 days will terminate this agreement requiring execution of a new agreement, with forfeiture of any past payments towards purchase.
NSF AND LATE FEES: If any amount due is rejected by Customer’s bank or credit card for any reason, an NSF fee (maximum allowed by law) will be assessed per occurrence. If any payment is past due by more than 3 days, a $5.00 late fee will be accessed per occurrence. These fees may be collected via autopay at any time without notice.
DEFAULT: If any amount due remains past due for more than 15 days after written notice from VMC regarding said default, or VMC deems the instrument is being abused or neglected, this agreement shall be terminated.
TERMINATION: VMC may terminate this agreement, with or without notice, in the event VMC deems the instrument is being abused or neglected or upon Customer failing to timely cure any monetary default after receipt of written notice from VMC. Upon termination, Customer agrees to return the instrument to VMC within 16 days. Customer also authorizes a representative of VMC to repossess the instrument at Customer’s home or school without notice and authorizes the assistance of school personnel in retrieval.
REINSTATEMENT: If Customer fails to make a payment within 15 days after receipt of written notice from VMC, which leads to termination or repossession of the instrument, other than through judicial process, the right for the Customer to reinstate the agreement by payment in full of all due rental payments and fees will be extended for a period of not less than 30 days if Customer has paid less than 60% of the total amount to be paid to acquire ownership of the instrument and will be extended for a period of not less than 60 days if the Customer has paid 60% or more of the total amount to be paid to acquire ownership of the instrument. Upon reinstatement, VMC will provide the Customer with the same instrument or substitute instrument of comparable quality and condition and will also provide the same disclosures as in this original agreement.
COLLECTION AND BANKRUPTCY: VMC may forward any past-due amounts and/or replacement costs to a 3rd party collection agency. Customer agrees to pay for all costs incurred for legal and/or collection attempts. This is a rental agreement and is therefore not subject to any provision of bankruptcy law.

INCLUDED REPAIR AND REPLACEMENT COVERAGE (R&R): Customer is automatically enrolled in the R&R coverage, which covers the instrument for any repairs necessary to restore the instrument to Good Playing Condition (GPC) and loss due to accidental damages. Replacement due to fire, theft, or vandalism is covered upon receipt of a police report. Coverage includes only repair and replacement of the instrument and carrying case and does not include any accessories, missing parts, or damages or loss due to abuse or neglect, which is at the sole discretion of VMC. This coverage will be null and void upon any payment in arrears or default of this agreement. Only VMC personnel are authorized to make repairs, and customer is responsible for any damages from unauthorized repairs.

REPAIRS, DAMAGES, MAINTENANCE, AND LOSS: The instrument will be delivered to the customer in Good Playing Condition (hereafter referred to as “GPC”). If the R&R Coverage is null and void due to any payment in arrears or default of this agreement, customer will be liable for any and all costs for repair, damages, and maintenance to restore the instrument to GPC during this agreement or upon return of the instrument. Customer agrees to pay up to the “Maximum Amount of Consumer Liability” listed above for any loss or replacement costs of the instrument, which may be collected via autopay without notice.

CANCELATION / RIGHT TO CANCEL: You may cancel this agreement at any time by returning the instrument to our store or by contacting us via email or the online rental return form on our website for home or school pickup. Any payments made towards purchase are forfeited. LEAVING THE INSTRUMENT AT THE SCHOOL WITHOUT VERIFIED NOTICE TO VMC DOES NOT CONSTITUTE CANCELATION.

If this agreement was signed away from our primary place of business, YOU, THE BUYER, MAY CANCEL THIS TRANSACTION AT ANY TIME PRIOR TO MIDNIGHT OF THE THIRD (3RD) BUSINESS DAY AFTER THE DATE OF THIS TRANSACTION FOR A FULL REFUND.

This document contains the entire agreement of the parties. No modifications or changes in this agreement shall be enforceable unless in writing, dated, and signed by both parties. In the event that any term or provision of this agreement is found by a court of competent jurisdiction to be invalid or unenforceable, that term or provision shall be deemed severed from this agreement and shall not impair the validity of the remaining provision hereof.

PAGOS: Este es un contrato de alquiler y compra de mes a mes que se renueva automáticamente con cada pago mensual. El Cliente puede cancelar el contrato de alquiler en cualquier momento devolviendo el instrumento a Voigt Music Center, Inc (en adelante, "VMC"). El pago del primer mes no es reembolsable. No se otorgarán reembolsos por meses parciales después de 5 días calendario de un pago.

AUTOPAY: El Cliente autoriza un pago automático a través del método de pago registrado para los pagos de alquiler mensuales iniciales y posteriores en la fecha de pago automático indicada anteriormente, y en la misma fecha de cada mes posterior, hasta que el instrumento haya sido devuelto a la tienda y / o se hayan satisfecho todas las deudas relacionadas con este acuerdo. El Cliente es un firmante debidamente autorizado de la cuenta mencionada anteriormente y autoriza este acuerdo mediante su firma a continuación.

TÍTULO Y PROPIEDAD: El título, la propiedad y el derecho de posesión del instrumento y los accesorios incluidos (en adelante, denominados colectivamente "instrumento") permanecerán con VMC hasta que los "Pagos totales a la propiedad", más cualquier alquiler vencido, retraso o tarifas de NSF se hayan pagado en su totalidad. Solo los pagos de "Alquiler mensual" (sin incluir impuestos) se aplicarán a la compra del instrumento. Solo después de que el "Total de pagos por propiedad", más cualquier alquiler vencido, cargos por pago atrasado o NSF se hayan pagado en su totalidad, el título del instrumento se transferirá al Cliente. El cliente acepta no vender, disponer o hipotecar el instrumento hasta que la propiedad se transfiera al cliente.

DESCUENTO DE PAGO ANTICIPADO: Un descuento del 30% del saldo restante está disponible en cualquier momento para tomar posesión del instrumento.  El pago debe hacerse en su totalidad e incluir cualquier otro monto adeudado en virtud de este acuerdo.

INTERRUPTORES DE INSTRUMENTO: El instrumento puede cambiarse a un instrumento diferente dentro de los 60 días posteriores a la fecha de este acuerdo, y cualquier pago de "Alquiler mensual" realizado se transferirá al instrumento de reemplazo. Cualquier cambio de instrumento después de 60 días terminará este acuerdo que requiera la ejecución de un nuevo acuerdo, con la pérdida de cualquier pago pasado para la compra.

NSF Y CARGOS POR PAGO ATRASADO: Si cualquier cantidad adeudada es rechazada por el banco o la tarjeta de crédito del Cliente por cualquier motivo, se cobrará una tarifa de NSF (máximo permitido por la ley) por ocurrencia. Si algún pago está vencido por más de 3 días, se accederá a un cargo por pago atrasado de $ 5.00 por ocurrencia. Estas tarifas se pueden cobrar a través del pago automático en cualquier momento, sin previo aviso.

INCUMPLIMIENTO: Si cualquier cantidad adeudada permanece vencida durante más de 15 días después de la notificación por escrito de VMC con respecto a dicho incumplimiento, o VMC considera que el instrumento está siendo abusado o descuidado, este acuerdo se rescindirá.

TERMINACIÓN:  VMC puede rescindir este acuerdo, con o sin previo aviso, en caso de que VMC considere que el instrumento está siendo abusado o descuidado, o si el Cliente no subsana oportunamente cualquier incumplimiento monetario después de recibir una notificación por escrito de VMC.  Tras la terminación, el Cliente acepta devolver el instrumento a VMC dentro de los 16 días.  El Cliente también autoriza a un representante de VMC a recuperar el instrumento en el domicilio o escuela del Cliente sin previo aviso y autoriza la asistencia del personal de la escuela en la recuperación.

REINSTALACIÓN:  Si el Cliente no realiza un pago dentro de los 15 días posteriores a la recepción de la notificación por escrito de VMC, lo que conduce a la terminación o recuperación del instrumento, que no sea a través de un proceso judicial, el derecho del Cliente a restablecer el acuerdo mediante el pago completo de todos los pagos y tarifas de alquiler adeudados se extenderá por un período de no menos de 30 días si el Cliente ha    pagado menos del 60% del monto total que se pagará para adquirir la propiedad del instrumento y se  extenderá por un período de no menos de 60 días si el Cliente ha pagado el 60% o más del monto total a pagar para adquirir la propiedad del instrumento.  Tras la reincorporación, VMC proporcionará al Cliente el mismo instrumento o instrumento sustituto de calidad y condición comparables y también proporcionará las mismas  divulgaciones que en este acuerdo original.

COBRO Y BANCARROTA: VMC puede enviar cualquier monto vencido y / o costos de reemplazo a una agencia de cobro de 3 ª parte. El Cliente acepta pagar todos los costos incurridos por intentos legales y / o de cobranza. Este es un contrato de alquiler y, por lo tanto, no está sujeto a ninguna disposición de la ley de Bancorto.

COBERTURA DE REPARACIÓN Y REEMPLAZO INCLUIDA (R&R): El cliente queda automáticamente inscrito en la cobertura R&R, que cubre el instrumento por cualquier reparación necesaria para restaurar el instrumento a buenas condiciones de reproducción (GPC) y pérdida    debido a daños accidentales. El reemplazo debido a incendio, robo o vandalismo está cubierto al recibir un informe policial. La cobertura incluye  únicamente la reparación y el reemplazo del instrumento y el estuche de transporte y no incluye ningún accesorio, piezas faltantes ni daños o pérdidas debido a abuso o negligencia, lo cual queda a exclusivo criterio de VMC. Esta cobertura  quedará nula ante cualquier pago atrasado o incumplimiento de este acuerdo. Sólo el personal de VMC está autorizado a realizar reparaciones y el cliente es responsable de cualquier daño causado por reparaciones no autorizadas.

REPARACIONES, DAÑOS, MANTENIMIENTO Y PÉRDIDA: El instrumento se entregará al cliente en buenas condiciones para tocar (en adelante, "GPC"). Si la Cobertura R&R es nula debido a cualquier pago atrasado o incumplimiento de este acuerdo, el cliente será responsable de todos y cada uno de los costos de reparación, daños y mantenimiento para restaurar el instrumento a GPC durante este acuerdo o al devolver el instrumento. El Cliente acepta pagar hasta el “Cantidad Máxima de Responsabilidad del Consumidor” mencionado anteriormente por cualquier pérdida o costo de reemplazo del instrumento, que puede cobrarse mediante pago automático sin previo aviso.

CANCELACIÓN / DERECHO DE CANCELACIÓN: Puede cancelar este acuerdo en cualquier momento devolviendo el instrumento a    nuestra tienda, o poniéndose en contacto con nosotros por correo electrónico o el formulario de devolución de alquiler en línea en nuestro sitio web para recoger en el hogar o la escuela. Cualquier pago realizado para la compra se pierde. DEJAR EL INSTRUMENTO EN LA ESCUELA SIN PREVIO AVISO VERIFICADO A VMC NO CONSTITUYE CANCELACIÓN. Si este acuerdo se firmó fuera de nuestro lugar principal de negocios, USTED, EL COMPRADOR, PUEDE CANCELAR ESTA TRANSACCIÓN EN CUALQUIER MOMENTO ANTES DE LA MEDIANOCHE DEL TERCER (3ER) DÍA HÁBIL DESPUÉS DE LA FECHA DE ESTA TRANSACCIÓN PARA OBTENER UN REEMBOLSO COMPLETO.

Este documento contiene el acuerdo completo de las partes. Ninguna modificación o cambio en este acuerdo será ejecutable a menos que sea por    escrito, fechado y firmado por ambas partes. En el caso de que un tribunal de jurisdicción competente determine que cualquier término o disposición de este acuerdo es inválido o inaplicable, dicho término o disposición se considerará separado de este acuerdo y no afectará la validez de la disposición restante del mismo.
